{"id":3878,"date":"2018-08-21T10:02:33","date_gmt":"2018-08-21T14:02:33","guid":{"rendered":"https:\/\/jeremy-wu.info\/?p=3878"},"modified":"2018-08-21T10:02:33","modified_gmt":"2018-08-21T14:02:33","slug":"nsd201801-015","status":"publish","type":"post","link":"https:\/\/jeremy-wu.info\/?p=3878","title":{"rendered":"NSD201801-015"},"content":{"rendered":"<h4>Trade Secrets for Technologically Advanced Titanium to China<\/h4><p>On Dec. 16, 2016, in the District of\u00a0Connecticut, Yu Long, a citizen of China and lawful permanent resident of the U.S., waived his right to\u00a0be indicted and pleaded guilty to charges related to his theft of numerous sensitive military program\u00a0documents from United Technologies and transporting them to China. Long pleaded guilty to one count\u00a0of conspiracy to engage in the theft of trade secrets knowing that the offense would benefit a foreign\u00a0government, foreign instrumentality or foreign agent. He also pleaded guilty to one count of unlawful\u00a0export and attempted export of defense articles from the U.S., in violation of the Arms Export Control\u00a0Act. On June 27, 2017, Yu Long was sentenced to time served and a special assessment of $200.\u00a0Previously, on Nov. 7, 2014, Long was arrested in Ithaca, NY, pursuant to a federal criminal complaint\u00a0which charged Long with attempting to travel to China with sensitive proprietary documents that set forth\u00a0detailed equations and test results used in the development of technologically advanced titanium for U.S.\u00a0military aircraft. The documents were taken from a Connecticut defense contractor where Long had been\u00a0employed. Long attempted, two days earlier, to fly to China from Newark Liberty International Airport\u00a0in New Jersey. As alleged in the complaint affidavit and in statements made in court, Long holds Chinese\u00a0citizenship and is a lawful permanent resident of the U.S. From approximately Aug. 2008, to May 2014,\u00a0Long worked as a Senior Engineer\/Scientist at a research and development center for a major defense\u00a0contractor in Connecticut (\u201cCompany A\u201d). Both during and after his employment there, Long traveled to\u00a0the People\u2019s Republic of China. Most recently, on Aug. 19, 2014, Long returned to the U.S. from China\u00a0through John F. Kennedy International Airport in New York. During a secondary inspection screening by\u00a0U.S. Customs and Border Protection (CBP) officers, Long was found in the possession of $10,000.00 in\u00a0undeclared U.S. cash, registration documents for a new corporation being set up in China, and a largely\u00a0completed application for work with a state-controlled aviation and aerospace research center in China.\u00a0The application materials highlighted certain of Long\u2019s work history and experiences that he claimed to\u00a0have obtained while employed at Company A, including work on F119 and F135 engines. The F119\u00a0engine is employed by the U.S. Air Force F-22 Raptor fighter aircraft. The F135 engine is employed by\u00a0the U.S. Air Force F-35 Lightning II fighter aircraft. The criminal complaint and statements made in court\u00a0further state that on Nov. 5, 2014, Long boarded a flight from Ithaca to Newark Liberty International\u00a0Airport, with a final destination of China. During Long\u2019s layover in Newark, CBP officers inspected\u00a0Long\u2019s checked baggage and discovered that it contained, among other things, sensitive, proprietary and\u00a0export controlled documents from another major defense contractor located outside the state of\u00a0Connecticut (\u201cCompany B\u201d). Further investigation determined that the U.S. Air Force had convened a\u00a0consortium of major defense contractors, including Company A and Company B, to work together to see\u00a0whether they could collectively lower the costs of certain metals used. As part of those efforts, members\u00a0of the consortium shared technical data, subject to stringent restrictions on further dissemination.\u00a0Company B reviewed the Company B documents found in Long\u2019s possession at Newark Liberty Airport\u00a0and confirmed that it provided the documents to Company A as part of the consortium. Company B\u00a0further confirmed that Long was never an employee of Company B. A review of Company A\u2019s computer\u00a0records indicated that Long had printed the documents while employed at Company A. The documents\u00a0bore warnings that they contained sensitive, proprietary and export-controlled material, which could not\u00a0be copied or communicated to a third party.
